These Terms and Conditions govern the sale of products and services by MVD Motorsports B.V., trading as MVD Racewear, through mvdracewear.com. By placing an order or using our services, you agree to these terms.
1. Definitions
For the purposes of these Terms:

Cooling-off period: The period within which the consumer can exercise the right of withdrawal.

Consumer: A natural person acting outside the scope of business or profession who enters into a distance contract with the entrepreneur.

Day: Calendar day.

Distance contract: A contract concluded under an organized distance selling system without simultaneous physical presence of the parties.

Durable medium: Any means that allows the consumer or entrepreneur to store information personally addressed to them in a way that enables future consultation and unchanged reproduction.

Right of withdrawal: The consumer's right to cancel a distance contract within the cooling-off period.

Model withdrawal form: The form provided by the entrepreneur for exercising the right of withdrawal.

Entrepreneur: The legal entity offering products or services remotely.

3. Applicability
These Terms apply to all offers, orders, and agreements between MVD Racewear and consumers. Before concluding a distance contract, these Terms will be made available in a manner that allows easy storage and reproduction. In case of inconsistencies with specific product or service terms, the most favorable condition for the consumer prevails.
4. The Offer
All offers are non-binding and may be updated or withdrawn at any time. Offers include sufficient product descriptions and, where applicable, images that are as accurate as possible. Color variations may occur and are not grounds for complaints or refunds.
5. Conclusion of the Agreement
An agreement is concluded when the consumer accepts the offer and meets all conditions. Confirmation will be sent electronically. Until confirmation is received, the consumer may cancel the order. Appropriate technical and organizational measures are taken to secure electronic communication and payment.
6. Right of Withdrawal
Products: Consumers may cancel the order within 30 days of receipt without giving reasons. Products must be returned in their original condition and packaging, with all accessories. Notification must be made using the model withdrawal form, and returned within 14 days of notification.
Services: Consumers may cancel service agreements within 14 days without giving reasons, starting from the day the agreement is concluded.
7. Costs of Withdrawal
The consumer bears the cost of returning products. Refunds will be processed within 14 days after receipt of the returned product or proof of shipment.
8. Exceptions to Withdrawal
The right of withdrawal does not apply to:

Customized or personalized products

Perishable goods

Sealed hygiene or software products once opened

Services started with explicit consumer consent before the cooling-off period expires

Event tickets, reservations, gambling, or lotteries
9. Prices
Prices include VAT and are binding for the validity period stated in the offer. Prices may fluctuate due to changes in taxes or financial market conditions. Price errors are not binding on the entrepreneur.
10. Conformity and Warranty
Products must meet the agreement, specifications, and reasonable quality standards. Legal warranties remain unaffected. Defects must be reported within 4 weeks of delivery. Products must be returned in original condition and packaging. Manufacturer warranties are respected but do not guarantee suitability for individual use.
11. Delivery
Delivery occurs to the address provided by the consumer. Orders are shipped within 30 days, unless agreed otherwise. Delays will be communicated promptly. Risk passes to the consumer upon delivery unless explicitly agreed otherwise.
12. Duration, Termination, and Renewal of Agreements

Termination: Consumers may terminate agreements for regular deliveries of products or services with maximum one-month notice.

Renewal: Agreements for a fixed period are not automatically renewed unless explicitly agreed. Trial subscriptions (newsletters, periodicals) end automatically. Agreements longer than one year can be terminated with one-month notice after the first year.
13. Payment
Amounts owed must be paid within 7 days after the start of the cooling-off period or receipt of confirmation for services. Late payment may incur statutory interest and collection costs.
14. Complaints
Complaints must be submitted within 7 days of discovering a defect. Complaints will be acknowledged within 14 daysand resolved in accordance with our complaints procedure. Unresolved complaints can be submitted to Stichting WebwinkelKeur or GeschilOnline.
15. Disputes
Dutch law applies to all agreements. The UN Convention on Contracts for the International Sale of Goods does not apply.
16. Additional or Deviating Provisions
Any deviations or additional terms must not disadvantage the consumer and must be recorded in writing or in a reproducible format.
Do you ship overseas?
Yes, we ship all over the world. Shipping costs will apply, and will be added at checkout.
How long will it take to get my orders?
It depends on where you are. Orders placed within europe will take 1-5 business days to arrive. Overseas deliveries can take anywhere from 7-16 days. Delivery details will be provided in your confirmation email.
Can I return my order for a refund?
If you are not satisfied with your purchase from MVD Racewear, you can return your order for a full refund (less shipping fees) within 30 days of the date of purchase. All items returned for a refund must be in unworn, unused, unwashed condition, with original tags still attached.
Are returns free?
Yes, we offer free returns on all eligible items.
I want to return my item(s), what do I need to do?
You can use this link for our return portal: https://mvdracewear.shipping-portal.com/rp/. Please make sure you read our return policy.
Who will deliver my parcel?
We will send your order through DPD home. DPD Home can deliver your parcel on Monday to Friday and when requested on Saturday. As soon as your order is ready to be shipped, you will receive a tracking code by e-mail so you can track the shipment yourself.
Will an order of several items be shipped in one parcel?
Yes, when you order at MVD Racewear, your order will be shipped in one package. The product with the longest delivery time is leading for the delivery of your order. Should you wish to receive a product earlier, we recommend you to place two separate orders.
What happens if I am not at home when my parcel arrives?
Are you not at home to collect your parcel? On the note left by the courier, you can see what you can do to collect your parcel.
My order is incomplete or damaged, what now?
Please contact our customer service, we are happy to help.
Can I also collect my order?
Yes, you can collect your order on weekdays from 9.00 am to 5.00 pm. Please contact our customer service to schedule an appointment, so we can confirm your order will be ready for you.
Can I also pay cash when I collect my order?
Yes, no problem at all! Simply order your product online on our website and choose ‘Collect’ at delivery method. As payment method, you choose ‘ Bank transfer’. When you collect your order, you can pay cash with the exact amount. Please note there is no option to use PIN.
Do you own a store where I can try your clothing?
No, unfortunately we do not own a physical store. We are a web shop with a warehouse only. Should you be near or in the Eindhoven Area, you may contact us to schedule a fitting appointment.
